Took our deposit and not carried out the work

We paid our deposit over 3 months ago. Scheduled the work for end of September. We’ve been let down 4 times, told poor excuses each time and I’ve constantly had to chase for a response. Now, apparently we can’t have the deposit back even after being let down over numerous times the last three months. Due to ‘terms and conditions’ i never agreed to
